Consumer Protections

Warranties and the Uniform Commercial Code

May I simply use lemon laws and consumer protection statutes instead of automobile warranties?

You may use any of these options. But note that there are differences among these laws, and that they may provide for different kinds of remedies. If you are in the position of taking legal action against a seller, consult a lawyer about what options you have under federal and state law.

If you can prove that the seller engaged in fraud or deception, you may be able to take advantage of your state's laws concerning unfair or deceptive acts and practices. If the car truly is a lemon, you may have options under your state's lemon law. Keep all of your papers concerning the car, including records and receipts.
