Personal Injury
The Basics of Personal Injury Law
John was driving to work. He was in moving traffic when he felt the urge to sneeze. He sneezed, involuntarily closed his eyes, and the car swerved into another lane. John panicked, accidentally pressed the accelerator instead of the brake, and caused a major pileup. Noreen was waiting for the bus with her brother when she witnessed the accident. John's car ran up onto the sidewalk and Noreen's brother was killed instantly. Noreen has become a nervous wreck. She is in therapy, has nightmares and flashbacks, and has had to leave her job. A local newspaper covered the accident. The cover story stated that John (who was not injured) was drunk when he caused the accident.
Several people may have a personal injury case arising from the scenario above. Certainly, the people injured in the accident might be able to bring a case against John, but Noreen also might be able to bring a case against John for the injuries she suffered as a result of witnessing her brother's death. John himself might have a case against the newspaper for defamation.
