What is a mechanic's lien?

A mechanic's lien is a lien created by law for the purpose of securing payment for work performed or materials furnished in construction. A mechanic's lien is subordinate to any prior mortgage on your house, but the contractor may use it to enforce payment by threatening a foreclosure action on your house. In some states, contractors and subcontractors must notify a homeowner if they intend to take out a lien. In others, you only learn about it after it is filed at the local recording office. If you find out someone has filed a lien, call your lawyer immediately.
