Introduction
Most consumers know very little about the way the law affects their lives. But without this knowledge, you can be financially exploited. As a practicing lawyer, I see the mistakes people make-entering into deals without investigating the facts; making expensive purchases without reading or understanding the fine print; and worst, failing to take simple steps to protect their rights. The consequences of these acts are often very costly. Problems can, however, usually be avoided if you know what to do.
This book contains practical strategies for many of the consumer decisions you are faced with. Whatever your background, education, and experience, you can learn how to detect problems before they occur and be aware of the legal consequences of your acts. Much of this information can be implemented without a lawyer. And even if litigation becomes necessary, your chances of success increase substantially when you have recognized the problem and documented your claim.
Many of the items discussed encompass simple rules of common sense and reason. For example, when you are making an expensive purchase or hiring an architect, there is no limit to the kinds of provisions that can be negotiated and inserted into the purchase agreement or contract. Imaginative use of written agreements can result in significant protections and savings.
To be adequately protected, consumers must apply the principles of "preventive law" in all their dealings. Maintain careful records of your transactions, send letters of protest to document your dissatisfaction whenever problems arise, and take proper steps without delay to enforce your rights where warranted. You can help enhance your legal position whether you decide to settle a dispute or litigate, provided you act promptly and properly.
By using this book as your guide and learning the applicable laws in your state, you can minimize potential areas of conflict. There is a large body of consumer law created to further fairness and justice. It is there to protect you, so know the law and enforce your rights. An informed consumer always:
- asks questions
- reads the fine print +investigates credentials and checks references +gets the terms of the deal in writing
- sends a letter or agreement confirming the deal if none is received
- keeps careful records
- protests unfair or illegal treatment promptly
- follows up with stronger action if satisfaction is not received
- researches applicable law and consults an attorney immediately when necessary
- knows his or her rights
Using this book as your guide, you can avoid problems in many common consumer transactions and enforce your rights if problems arise.
