You Must Remember This

  • A living trust can be a useful device – but it doesn’t work automatically and all by itself.

  • To avoid probate, it must be properly funded.

  • Be sure to coordinate it with the rest of your estate plan.

  • It must be maintained after it’s set up—i.e., by putting newly acquired assets into it, making sure the beneficiary designations are up to date, etc.
