Ask a Lawyer : Chapter 23 - Changing, Adding, Revoking Your Will or Trust

Changing a Living Trust

Q. What if I set up a revocable living trust, then change my mind about it?

A. You can make smaller changes by using an amendment. You can make larger changes by using a restatement. Over time, attorneys learn how to better address certain situations and the law changes. Many clients end up with a restatement of their trust after a certain period of time to reflect changes in the law, the tax law, and in their preferences and directions.
