964. What is a "foreign affiliate"?

A "foreign affiliate" of an American employer is a foreign entity that:

1. The American employer has not less than a 10 percent direct interest or indirect interest in; and

2. Is defined in section 3121(l)(8) of the Internal Revenue Code.
